Marcela Montoya Remodeling (“MMR”) has a very simple privacy policy:

We do not share any of your personal information with anyone.

We are pleased you have visited our web site. Please understand, however, that the content on this web page is informational in nature only.

Any links contained on this website are for the use and enjoyment of our visitors. MMR does not intend such links to be referrals or endorsements of the linked entities, nor do we warrant, endorse or approve any linked information or entity; and the existence of any particular link is simply intended to imply potential interest to the reader.

All Content on this website (“Content” is the text, graphics, design, and programming on the website) is the property of MMR, or the property of third parties as indicated, and is protected by U.S. copyright and international treaties. You may not reproduce, modify, display, sell, or distribute the Content, or use it in any other way for public or commercial purposes. MMR does not assume any obligation for the accuracy, completeness, or truthfulness of any of the Content of the website.

You may not send unsolicited commercial emails to the email addresses provided on the website. Your agreement to the following terms, disclaimers, and limitations is a material inducement to MMR, to permit you to access the website. Your use of the website, and the obligations and liabilities of MMR in respect of your use of the web site, is expressly limited as follows:

We created a Privacy Policy (“Privacy Policy”) in order to ensure the confidence of visitors and customers (“you” or “your”) of and to our Web site (the “Site”) and to demonstrate our commitment to fair information practices and the protection of privacy.  Throughout cyberspace, we want to contribute to providing a safe and secure environment for consumers, and in particular, ensure that your personal information is protected.

1. Types of Information

  • Traffic Data. Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We may track and collect the following information when you visit our Site: (i) IP address; (ii) domain server; (iii) type of computer; and (iv) type of web browser (collectively “Traffic Data”). We may use a technology nicknamed “cookies” that tells us how and when pages on our site are visited and by how many people. We may cookies to customize content specific to your interests, to ensure that you do not see the same advertisement repeatedly, and to store a password, so you do not have to re-enter it each time you visit the Site.
  • Personal Information. Personal Information may include the following: (i) Contact Data (such as your name, mailing, and e-mail addresses); and (ii) Demographic Data (such as your zip code and address). If you communicate with us by e-mail, post messages to any of our chat groups, bulletin boards, or forums, or otherwise complete online forms, surveys, or contest entries, any information provided in such communication may be collected as Personal Information.

2. Uses of Personal Information

We may use Contact Data to send you information about our company or our products or services, or to contact you when necessary. We may use your Demographic Data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.

3. User Choice Regarding Collection, Use, and Distribution of Personal Information

You may choose not to provide us with any Personal Information. In such an event, you can still access and use much of the Site; however, you will not be able to access and use those portions of the Site that require your Personal Information.

4. Confidentiality and Security of Personal Information

Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to (a) comply with a court order or other legal process; (b) protect our rights or property, or (c) enforce our Terms of Service. Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.

5. Telemarketing Activities

If you supply us with your telephone number, you may receive telephone calls from us with information regarding new products and services or upcoming events. If you do not wish to receive such telephone calls, please let us know when you speak with us.

If you request a copy of our “Do Not Call” policy, we will send you a copy via U.S. mail.

You may request, by telephone or in writing, that our company stop calling you and place your name on a Do Not Call list. Although we may ask for your name, address, and telephone number, we will accept your request even if you only provide your telephone number. You have a right to have calls stopped and to be put on our Do Not Call list even if you are still a customer.

When we receive your request, your telephone number is added to our Do Not Call list within seven (7) business days. In some cases, it may take up to fifteen (15) business days for your telephone number to be removed from other company-wide calling lists. Your request will stay on our list for at least five (5) years. If you move, change your telephone number, or add an additional telephone number, you must provide us with the new telephone number in order for us to prevent calls to that number. We will not share the information you provide with anyone except affiliated companies or subsidiaries without your prior written permission.

All company employees who engage in outbound telephone solicitation are trained in this policy and made aware of these procedures before they are allowed to place calls to consumers. Managers, supervisors, or trainers review the policy with these employees annually.

If you notify us that you have received a telephone call from us after you have already requested to be placed on our Do Not Call list, we will apologize for the intrusion and have a manager or supervisor investigate. The manager or supervisor will also personally confirm that the telephone number is on the Do Not Call list. Upon request, we will mail you a confirmation that your telephone number is on the list. The methods and procedures in this Do Not Call policy are reviewed by a Call Center Project Manager annually.

6. Other Sites

The Site may contain links to other Web sites. We are not responsible for the privacy practices or the content of such Web sites. We also make chat rooms, forums, message boards, and news groups available to you. Please understand that any information that is disclosed in these areas becomes public information. We have no control over their use, and you should exercise caution when deciding to disclose your Personal Information.

7. Updates and Changes to Privacy Policy

We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site. Any such change, update, or modification will be effective immediately upon posting on the Site.

The website is provided “as is” and without any warranty whatsoever. MMR disclaims any and all express and implied warranties whatsoever, including, without limitation, the warranties of merchantability, title, non-infringement of third parties' rights, and fitness for a particular purpose.

In no event shall MMR be liable for any damages whatsoever, including, without limitation, direct, indirect, incidental, and consequential damages, lost profits, or damages resulting from lost data, lost employment opportunity, or business interruption, resulting from the use of or access to, or the inability to use or access, the Web site, whether based on warranty, contract, tort, or any other legal theory, and whether or not MMR is advised of the possibility of such damages.

These terms and conditions are governed by the internal substantive laws of the State of Florida, without respect to its conflict of laws principles. Jurisdiction for any claims arising under these terms and conditions shall lie exclusively with the state and federal courts of West Palm Beach, Florida. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. The failure of MMR to enforce any part of these terms and conditions shall not be deemed a waiver thereof and shall not prevent its later enforcement.
